1 - Application Field

The general terms and conditions of sale of Diva-music.com apply exclusively to the commercial relationship there is between Diva - 32 bis rue Raymond Poincaré - 54000 Nancy, France - and the purchaser (You).
The sales contract between You and Diva-music.com exists from the moment your order is accepted by Diva-music.com. This acceptance will be reputed to be full and to have been communicated to you when you receive an e-mail from Diva-music.com that confirms that your order has been processed. In order to avoid all difficulty concerning the law that applies to the contract, the latter will be reputed to have been concluded in France. Any litigation will be submitted to the jurisdiction of the French courts.
Your contract is governed by the conditions of sale that are current on the day you order your purchase.

2 - Stock / Out of stock items

Our offers are subject to availability. In spite of our vigilance, the products might be out of stock when you order them. In this case you will be notified via e-mail (insofar as the e-mail address you gave is functioning and belongs to you).
Then Diva-music.com will propose either a new waiting period if the product is only temporarily unavailable, or the cancellation and the refund for your order if the stock is exhausted.
In case of out of stock items, it is your duty to inform us within 72 hours whether you wish to maintain your order or to have it cancelled. Beyond this 72 hours' period, your order will be considered as firm and definitive.

3 - Confirmation of the order

Your order will receive a confirmation from Diva-music.com insofar as the e-mail address you gave is functioning and belongs to you. In any case, Diva-music.com advise you to keep and/or print a copy of the order form until the receipt of your purchase.

5 - Responsibility

Our offers are subject to availability. Thus Diva-music.com is not responsible for the non-performance of the concluded contract in case of stock outage or unavailability. Furthermore Diva-music does not have any responsibility regarding a delay in the contract execution or the unperformance of it in case of an act of God. If the event delays or prevents the order to be processed during a period exceeding 30 days, the order can be cancelled and in this case Diva-music.com will issue a full refund as soon as possible.
